We work exclusively on the basis of the latest version of the German Freight Forwarders' Standard Terms and Conditions (ADSp), which are printed overleaf or can be downloaded or printed from www.gericke-spedition.de and as such are part of the basis of the contract. Paragraph 23 of the ADSp restricts the legal liability for damage to goods according to Section 431 of the German Commercial Code to € 5 per kilo for goods in the custody of a haulage company, 2 SDRs per kilo for the transportation of goods (including sea transport) and beyond that to € 1 – 2 million or 2 SDRs per kilo for each case of damage or loss, depending on which sum is higher. Paragraph 27 of the ADSp does not apply as an agreement for other maximum liability sums in the sense of Article 25 of the Montreal Convention. We have transport insurance underwritten by Oskar Schunk KG. Haulage invoices are cash expenses, which are payable immediately after the invoice has been received.
